Terms of use

Terms of use.
For the Sary platform.

Terms governing Sary accounts, subscriptions and use of the platform.

Version and effective date:

1. Acceptance of the terms

By creating an account or using Sary, the account holder agrees to these terms and the privacy policy and confirms that they have the legal capacity and authority to contract on behalf of the business.

The required consent is presented separately during registration, and the document version and date are recorded. If you do not agree, do not create an account or use the service.

2. The service and artificial intelligence

Sary is a platform for sales and customer service through WhatsApp. It may include automated replies, products, orders, bookings, campaigns, analytics and external integrations.

AI outputs are probabilistic and may be inaccurate. Merchants must review settings, sensitive information, offers and prices. AI outputs must not be the sole basis for legal, financial or health decisions.

Parts of the service depend on WhatsApp and AI, communication and payment providers. Their availability and policy changes may affect the service.

3. Accounts and security

Users must provide accurate information, protect their password and devices, and notify us of suspected unauthorised access.

An account may be suspended for a security risk, abuse or breach, taking into account applicable rights and the circumstances.

Administrative accounts and store ownership carry significant permissions. The owner is responsible for managing team members and transferring ownership before requesting account deletion.

4. Plans, prices and payment

The price, currency, billing period and limits displayed on the pricing page or checkout at the time of purchase govern the order. Outdated prices or marketing materials are not a binding offer.

The payment gateway processes card information. Taxes or statutory charges may apply and will be displayed before payment confirmation where possible.

Recurring charges are not made automatically unless the user enables recurring renewal and provides valid payment authorisation in a flow explaining the amount, frequency and cancellation.

The refund policy displayed at purchase and mandatory statutory rights apply. These terms do not limit any right that cannot lawfully be waived.

5. Acceptable use and messaging

Unlawful or misleading content, impersonation, unauthorised access, unlawful data collection, spam and attempts to bypass rate limits or protections are prohibited.

Merchants must follow WhatsApp policies and electronic marketing requirements, obtain necessary permissions and provide a clear way to stop marketing messages.

Merchants are responsible for the content, offers, prices and consent associated with messages to their customers, and for the accuracy of product and service information supplied to the platform.

6. Customer data and privacy

The merchant determines the purposes of processing their customer data and ensures a lawful basis and appropriate notice. Sary processes the data to provide the service in accordance with the privacy policy.

Providers such as Green API, OpenAI, Tap and hosting services may be used as necessary to operate enabled integrations. Using them does not mean selling data.

The merchant must cooperate with Sary on data-subject requests and incidents and must not upload data they are not entitled to process.

7. Intellectual property

Rights in the platform, software and trademarks remain with Sary or its licensors. Users receive a limited, non-exclusive, non-transferable licence to use the service during their subscription.

The merchant retains their content and data and grants Sary only the permission needed to process it and operate the service under these terms and the privacy policy.

8. Availability and support

We aim for reliable operation but do not guarantee an uninterrupted or error-free service. Maintenance or restrictions may be necessary to protect security or comply with requirements.

A special service or support level applies only if expressly included in a written order or agreement.

9. Liability

To the extent permitted by law, we are not liable for indirect damage caused by misuse, inaccurate merchant data or an external provider outage beyond reasonable control.

Nothing excludes a liability or right that cannot lawfully be excluded or limited. Any permitted financial liability limit is determined under the agreement and fees paid for the service giving rise to the claim.

10. Cancellation and termination

Renewal or subscription cancellation is available under the account options and order terms. Its effect on the paid period and refunds follows the terms displayed at purchase and statutory rights.

Data subjects may request account deletion through the privacy centre. Limited encrypted financial records may be retained where necessary for accounting obligations or claims.

11. Law, changes and contact

These terms are governed by the laws of the Kingdom of Saudi Arabia, with jurisdiction determined by applicable legal rules.

We may update the terms when the service or law changes. We display the version and effective date and provide appropriate advance notice of material changes where required.

For enquiries, use the contact page. For data requests, use the privacy centre within your account.
